25b pesticide exemption not being accepted, seller support nightmare loop

(for mods, please help! case ID is 14525554741)

We are attempting to list a pesticide product which is exempt from FIFRA regulation. Under EPA regulations in 40 CFR 152.25, there are six categories of exempt pesticides. Ours fits into 25b, pheromones and pheromone traps. We selected the option which states the product is exempt, and then sent the product label and pics to Amazon at their request. We were eventually approved, but 2 days later were taken down again.

Amazon is now insisting that the product is not exempt from FIFRA, and asking for an EPA registration or establishment number. We couldn't register a pheromone trap with the EPA if we tried, but Amazon agents keep sending the same copy-paste message with no elaboration.

I'm trying to find out if Amazon doesn't believe pheromone traps are exempt from FIFRA, or if they have an issue with our label/listing content. There are plenty of similar product listings, openly declaring 'non-toxic' in their titles, bulletpoints and packaging, which is unequivocally illegal so I doubt the label or the product is the problem. It seems to be an AI flag with no humans willing to overturn. Can any mods help, please? The Case ID is 14525554741

I understand you have recently received restricted products policy violations for pesticides. I would like to provide further insight into the applicable policy as well as provide a few resources for you to utilize.

Under both Amazon and the FIFA act, "pesticides and pesticide devices include: (1) any product intended for preventing, destroying, repelling, or mitigating any pest and (2) any product that makes any antimicrobial, antifungal, antibacterial, anti-mold, or pesticide claims."

In addition to this information, there is also this important consideration: "Products that make any antimicrobial, antifungal, antibacterial, or other pesticide claim (for example, products marketed to disinfect, repel insects, remove allergens, or prevent bacteria) may be considered pesticides or pesticide devices under Environmental Protection Agency (EPA) regulations."

Occasionally. certain keywords or phrases can trigger the restricted product policies. Is there anything on your listing that alludes to a pesticide or pesticide device? Even if this is done so indirectly, it is considered as a pesticide or pesticide device. The policy page provided above has more information which I urge you to consider as you look over your listing.

While I can see that you have provided further explanation on pheromone and pheromone traps in the case ID you have provided, there still must be a claim or statement, or implications that you item should be used to prevent, destroy, repel, mitigate, or take any other similar action against any kind of pest.

Stevie.

Hi @Glenn_Amazon, we were denied again with the exact same copy-paste message after 15 days. No one is explaining why Amazon disagrees with the EPA that pheromone traps are exempt. I have tried tagging you in the other thread but to no avail--can you please help? The case ID is 14525554741

To anyone reading, our appeal (showing Amazon the very list of EPA exemptions they cite and begging them to read it) was once again denied by Amazon with the exact same nonsensical copy-paste message we've gotten dozens of times already, meaning the last 15 days were a complete waste of time. We still have not managed to sort out this simple issue, and don't think we ever will because it would require actual communication with a human. We are astounded by what's happening, and the fact that we're paying to be treated like this.
