ID 15562734781 Strange replies from APEX Patent Evaluation Team
Hello,
We've filed a Patent Infringement Complaint ID: 15395644821 and applied for APEX evaluation. The case was accepted. The infringing seller opted out of evaluation. The infringing listing was removed by Amazon. According to APEX rules, these are the requrements for issuing an APEX ID that can be used in possible future infringement cases.
But, the APEX ID was not granted because, as Patent Evaluation Team says (ID 15562734781), we have "not yet met the criteria for receiving an APEX ID at this time. We will not discuss this criteria" and "Further correspondence on this topic, absent a new application, may not receive a response". No explanation.
We've followed all APEX rules and policies. Don't know what to do at this point. Can anyone help?

My name is Dougal from the Community Manager Team and I would be happy to help where I can with your APEX application. I do not have access to the case ID you provided, but was able to find the Complaint ID associated with APEX and the application status of "Not granted."
Here is the Amazon Patent Evaluation Express help page. At the bottom of the page is a table that provides a definition to the application status received. "Either the application did not meet the criteria for an APEX ID, or the evaluator determined that none of the reported listings infringe on the patent."

My guess is that it is Amazon's way of telling you that you won by default.

You will only receive a granted claim that you can use on future infringers if a seller opts in and loses.
