DMCA notice from exclusive distributor
Hi, I received a DMCA from the "exclusive distributor" of a brand in the US (I did not know that a exclusive distributor existed in the market). I have two questions:
- Is it a DMCA violation to sell an original branded product without being the official brand distributor? I understand that they may not allow anyone else to sell the brand, what I am not sure if it is really a DMCA violation or other type of violation
- If positive, should I acknowledge the policy violation or is it better not to submit any response on the "PRODUCT POLICY COMPLIANCE" page
Any recommendations are highly appreciated.
Thank you

From what you have shared so far, this sounds like you have received copyright infringement complaints and you would like some guidance on resolving them successfully.
Here are some details about copyrights:
- You generally own the copyright of the photo you took or the video you filmed for your product.
- You generally do not own the copyright of photos or videos you found on someone else’s website, and you must not upload such content to a product detail page without the copyright holder’s permission.
To address these, you will 3 options...
-a retraction from the rights owner
-dispute by submitting a DMCA counter-notice
-acknowledgement (if available)
Before I can give guidance on which option would be best here, I will need to learn if there is copyright infringement found on your listings. Once you have reviewed the copyright help page I linked above, please let me know if you believe there is infringement found. From there we can discuss the best next steps.
Please also review the Intellectual Property Policy for Sellers help page for more information.
I am looking forward to your reply and assisting you from here. The forums community and I are here to support you.
Wishing you the best,
